EC Consultation on a ‘Clean and Open Internet’

The European Commission recently launched a consultation on the application of procedures for notifying and acting on illegal content hosted by online intermediaries. The consultation focuses on Notice-and-Action (N&A) procedures that start when someone notifies a hosting service provider about illegal content on the Internet, and end when a hosting service provider acts against the alleged illegal content. The consultation addresses the problems of conflicting jurisprudence and the fragmentation of N&A procedures across the EU, which can result in illegal content staying online too long while legal content might be taken down unnecessarily.
